General Terms and Conditions

Bioinformatics, Intelligent Computer Systems and Educational Technology Research Group of the University of Salamanca (hereinafter BISITE-USAL)(hereinafter, BISITE-USAL or BISITE) makes the e4YOU.org course portal (hereinafter, “e4YOU” or the “Portal”) available to Internet users, with access to it and the use and contracting of its services and/or content governed by the provisions of these General Terms and Conditions (hereinafter, the Terms).

1.- Purpose and Modification of the Terms. Entity responsible for e4YOU.

BISITE-USAL makes available to users (hereinafter, individually, the “User”, and collectively, the “Users”) the possibility of browsing, accessing the content and services of the Portal, and enrolling in and undertaking any of the training activities, courses, modules, blocks, programs, diplomas and/or qualifications (hereinafter, individually, the “Course”, and collectively, the “Courses”) available therein, provided that they do so in accordance with the provisions of these Terms.

In any case, BISITE-USAL reserves the right, at any time and without prior notice, to modify or remove the content, structure, design, services and conditions of access and/or use of this site whenever it deems appropriate, indicating the effective date of the latest update, as well as the right to interpret these terms in relation to any issues that may arise from their application. If a material change is made, we will notify you through one of the main means of communication, for example, by using the email address you provide to us.

If you continue to use our services after the changes take effect, you will thereby confirm that you accept those changes. The revised Terms will replace all previously stated Terms.

BISITE-USAL or the owner of the Portal is:

2.- Requirements for access, use and utilization of the Portal's services and content.

To use the services of the Portal, registration as a User is required.

Furthermore, some of the Portal's services will not be accessible without prior payment of the value or amount that may apply in accordance with the specific Terms of each product or service.

Access to and/or use of the Portal is entirely voluntary and grants the person doing so the status of User. Every User, whether or not registered on the Portal, accepts, from the moment they access it, without reservation of any kind, the content of these Terms, as well as, where applicable, any “Specific Terms” that may supplement, replace or modify them in some respect in relation to the different services and content of the Portal. Consequently, the User must carefully read both before accessing and using any service of the Portal under their sole responsibility.

In any case, BISITE-USAL reserves the right, at any time and without prior notice, to deny access to the Portal or deactivate or terminate the accounts of registered Users who breach any of these Terms or any specific terms applicable to them, in accordance with the provisions of section 9 “Loss of User Status” of these Terms.

3.- General Principles – User Responsibility.

The User undertakes to use the courses, services and content provided by the Portal in accordance with current legislation, as set out in clause 10 of these Terms, the principles of good faith and generally accepted practices, and not to contravene public order or the provisions of these Terms through their actions on the Portal. Therefore, any use for unlawful purposes or that harms or prevents, may damage and/or overload, in any way, the use and normal operation of the Portal, or that directly or indirectly harms BISITE-USAL, the Collaborators, Associates or “Partners” that provide the courses or their teaching teams, other Users or any third party, is prohibited.

The User of the Portal shall not transmit through the services, tools, utilities, ratings or comments on Portal content anything that violates the values and dignity of individuals, in accordance with national and international human rights protection standards.

The User of the Portal undertakes to provide true and accurate information about themselves in registration forms, to keep such information up to date and to provide as an external email address one that belongs to them.

Likewise, the reproduction, distribution, transmission, adaptation or modification, by any means and in any form, of the content of the Portal or its courses (texts, designs, graphics, information, databases, sound and/or image files, logos and other elements of these sites) is prohibited, except with the prior authorization of their legitimate owners or where permitted by a “creativecommons” license that may apply to the content or by applicable current legislation.

Likewise, with respect to the content detailed above, any commercial or advertising use other than that strictly permitted, where applicable, and, in general, any infringement of any rights arising from such content, is prohibited.

4.- Conditions to be met by users wishing to establish a hyperlink between their website and the Portal.

The reproduction of Portal pages by means of a hyperlink from another portal or website is not permitted; only access to them is permitted.

Under no circumstances may it be implied that BISITE-USAL authorizes the hyperlink or that it has supervised or in any way assumed responsibility for the services or content offered by the website from which the hyperlink originates.

False, incorrect or inaccurate statements or references regarding BISITE-USAL pages and services may not be made.

The page from which the hyperlink is established may not contain any distinctive sign referring to the Portal except for signs incorporated into the hyperlink itself.

The creation of any type of browser, program, “browser” or “borderenvironment” over the pages of the Portal is expressly prohibited.

The website from which the hyperlink is established may not include content contrary to the rights of third parties, contrary to accepted morals and good customs, or unlawful content or information.

The existence of a hyperlink between a website and the Portal does not imply the existence of any relationship between BISITE-USAL and the owner of that website, nor acceptance or approval of its content and services.

5.- User Responsibility. Posting comments on blogs and forums. Security measures.

5.1.- User responsibility.

The User shall be solely responsible for use of the Portal and for full compliance with these Terms. Consequently, the User undertakes to keep secret, as confidential and reserved information, their access codes, passwords or similar data assigned to access the Portal or any of its services, and shall be responsible for any damages of any kind arising from misuse by themselves or by third parties, both against the User themselves, including damage suffered as a result of their negligence, and damage that BISITE-USAL may suffer as a result of breach of these Terms.

5.2.- Use of e4YOU services.

Through the Portal's services, the User may share information, communicate and connect with other Users.

In relation to use of the Portal's services, the User assumes the following obligations:

a) Comply with the e4YOU “honesty commitment”, which entails assuming the following commitments:

Not to register on e4YOU with more than one account.
That answers to multiple-choice activities and P2P activities are the result of their own work and completed individually (except for those activities whose instructions explicitly allow collaboration).
Not to publish or otherwise provide solutions to assessment tasks with the intention of benefiting other Users.
Not to carry out actions that may dishonestly improve the results of assessment tasks, nor improve or harm the scores of other students.
Not to claim the work of others as their own.

b) The User shall use the Portal's services and course content for personal use and never for financial or commercial purposes without prior authorization from BISITE-USAL.

c) The User shall not provide false personal information on the Portal and shall be solely responsible for the genuine, truthful and up-to-date communication of their personal data.

d) The User shall not create a false profile account or impersonate a third party without their authorization.

f) The User undertakes to make reasonable use of the Portal and its content.

e) The User undertakes to ensure that any content they publish on the Portal, in forums, blogs or any other functionality, does not in any way violate current legislation, intellectual property rights, contractual rights or any other type of right that may be held by any natural or legal person, whether public or private.

BISITE-USAL shall under no circumstances be liable for improper use of the Portal and its content, with the User being solely responsible for any damages that may arise from misuse thereof or from infringement of the provisions of the Terms in which they may incur. The User undertakes to hold BISITE-USAL harmless against claims or penalties it may receive from third parties, whether individuals or public or private entities, as a result of such infringements, as well as against damages of any kind that it may suffer as a consequence thereof.

BISITE-USAL may remove any comment, content and information published on the Portal if it considers that these obligations are being violated by the User, if BISITE-USAL receives a claim from a third party for infringement of the conditions set out herein, or where such content may cause harm to it.

BISITE-USAL reserves the right to suspend and/or cancel the User's account on the Portal without prior notice and without this giving rise to any compensation, if it considers, at its own discretion, that the User has seriously breached these Terms.

5.3.- Posting comments on blogs and forums.

In relation to posting comments on the blogs or forums of the Portal, the User undertakes not to post comments that may be offensive, defamatory, insulting or slanderous toward BISITE-USAL or third parties, contrary to morals, public order or the dignity of individuals, or that may in any other way be unlawful or illegal or cause damage or harm to BISITE-USAL, the Collaborators, Associates or training “Partners” or their teaching teams, or third parties.

BISITE-USAL reserves the right to immediately remove, without prior notice, from blogs and forums any comments that, in its judgment, fail to comply with the provisions of the preceding paragraph.

6.- Purchase process:

6.1. in general, regarding paid products and services.

Some of the products and services of the Portal, whether from e4YOU, its collaborators and associates (collectively, e4YOU's “associates” or “Partners”), whether universities or other educational entities, corporations or for-profit and nonprofit companies, governments, government bodiesor units, and other types of institutions, may offer services and products for a fee (for example, courses, programs, certificates, qualifications, etc.). For any product or service that the user decides to purchase on the Portal that is not free of charge, the user agrees to pay all applicable fees before their due date.

6.2. regarding paid products and services, and their refund or withdrawal policies

In order to make purchases, the user must log in to the Portal and click on the course from which they wish to obtain the product they want to purchase (for example, a Certificate of Completion).

6.2.1. Issuance of certificates by e4YOU, in relation to courses completed by users:

Certificates issued directly by the Portal are either Certificates of Attendance or Certificates of Completion. Both types of certificates certify completion of the course by the registered user, while only Certificates of Completion also certify, in addition to completion, that the user has successfully completed the course, in all cases under the first and last name indicated on the certificates issued by the Portal, but they do not guarantee that completion of the courses by the natural person corresponds to the first and last name of the user registered on e4YOU who completes them.

The purchase of a product or service from the Portal shall not generate any electronic legal purchase document, without prejudice to proper recording of the transaction by BISITE-USAL.

The user shall have a period of two months from the end of the course to download their Certificates; after that period, the Portal may disable access to them.

6.2.1. a) Issuance of the Certificate of Attendance.

The Certificate of Attendance is free of charge and can be downloaded automatically. The user may obtain it by meeting the requirements established for each training activity.

6.2.1. b) Issuance of the Certificate of Completion.

The Certificate of Completion, on the other hand, has a cost that will depend on the features requested by the user (for example, “Certificate of Completion: online”, “Certificate of Completion: online and printed, with delivery to Spain”, “Certificate of Completion: onlineandprinted, with delivery outside Spain”, etc.).

From the application form, the user must complete their details, select the certificate option they prefer, andat the end of the form accept the conditions. A user record will be created and the user may request the issuance of an invoice and continue with the payment process, and must review the accuracy of the information entered.

The user may make payment by debit/credit card (VISA and MASTERCARD) or PayPal (recommended) from within the campus through the payment gateway. Likewise, they may make a bank transfer or deposit, requesting the account details in writing by email addressed to campus@e4YOU.org.

If the user wishes to change any information after payment has been made, they may request this in writing by email addressed to campus@e4YOU.org, although correction is not guaranteed.

Once the transfer or deposit has been made, the user must send by email a copy of the bank document proving completion of the transaction, indicating the name of the person.

Once all fees have been paid, the user would be notified by electronic mail (or “email”) that their application is confirmed.

Finally, oncefees have been paid, the user will be able to download their diploma (online) from the same payment record.

If the user also requested delivery of the printed Certificate or Diploma, it will be sent to the postal address indicated in their record. If a Hague-apostilled diploma is requested, the notarial procedures may take more than 4 weeks.

It should be noted that, once payment has been made, no request for a refund of the Certificate of Completion will be accepted, since this file or document is generated automatically, with the user's prior express consent and their acknowledgment that they are aware of this.

6.2.1. c) Issuance of Certificates with academic or professional recognition and their refund or withdrawal policies.

The Collaborators, Associates or “Partners” of the Portal may issue Course Certificates (for example, Diplomas or Professional Certifications, Expert Qualification Diplomas or Master's Qualification Diplomas), which certify the degree of completion of the courses by the registered user, under the first and last name indicated therein, and include academic or professional recognition. The criteria for such certification will be expressly communicated by the collaborator, associate or “partner” that owns the course.

The refund or withdrawal policies forthe certificates with academic or professional recognition shall be those communicated by the “partner” that owns the course.

6.2.2. Acquisition of courses by users:

6.2.2. a) The Collaborators, Associates or “Partners” of the Portal may offer Paid Courses, forwhich they may issue Certificates certifying the degree of completion by the registered user, under the first and last name indicated therein, and including academic or professional recognition. The payment criteria for access to the Courses and the use and contracting of their services and/or content, as well as the criteria for the corresponding certification, will be expressly communicated by the collaborator, associate or “partner” that owns the course on the Course information page.

Likewise, the refund or withdrawal policies for these courses or the corresponding certificates with academic or professional recognition shall be those communicated by the “partner” that owns the course.

6.2.2. b) The Owner of the Portal may offer Paid Courses, whether its own or together with its collaborators and associates (collectively, the e4YOU “associates” or “Partners”), for which it may issue Certificates certifying the degree of completion by the registered user, under the first and last name indicated therein, and including academic or professional recognition. The payment criteria for access to the Courses and the use and contracting of their services and/or content, as well as those relating to the corresponding certification, will be expressly communicated on the Course information page.

For these courses and their corresponding certificates, the User has a maximum period of 14 calendar days from the contracting and payment of a course to exercise their right of withdrawal, provided that they have not accessed the course content. The User must notify BISITE-USAL unequivocally of their intention to withdraw from the contract, for example, by completing the following form and sending it to the following address: campus@e4YOU.org.

Once the withdrawal notification has been received, the User will no longer be able to access the course in question and we will proceed with a full refund of the course amount within a maximum period of 14 days.

7.- Exclusion of Warranties and Liability.

BISITE-USAL does not guarantee and shall under no circumstances be liable for the following facts and content, nor for any damages that may arise from them:

Lack of availability, continuity, access, maintenance and effective operation of the Portal and/or its services, and the updating, accuracy, completeness, relevance, timeliness and reliability of its content, whatever the cause and whatever the technical or other difficulties or problems giving rise to such circumstances.

The proper delivery of the courses available on the Portal by the Collaborators, Associates or “Partners” who uploaded them or by their teaching teams.

The quality, ownership, legitimacy, suitability or relevance of the materials, resources, videos, tests and other content used in the courses and the processing of the data of users enrolled in them by Collaborators, Associates or “Partners” and their teams of speakers, instructors and/or teaching staff.

The transmission and/or existence of viruses or other harmful elements for Users' equipment that may affect them as a result of access to, use of or browsing of the site, or that may cause alterations to their electronic documents or files.

Unlawful, negligent or fraudulent use, impersonating a third party or contrary to the content of these Terms, good faith, generally accepted practices or the public order of the Portal, its courses, services and content, by Users.

Except for those signs that form part of the hyperlink itself, the website on which this hyperlink is established shall not contain any trademark, trade name, establishment sign, name, logo, slogan or other distinctive signs belonging to BISITE-USAL.

Violations or infringements of laws, practices or customs in force relating to intellectual property rights, industrial property, business or contractual secrets, privacy rights, honor, image, property, advertising or competition, among others, of third parties.

Defects or faults in the courses, content and/or services accessed through the Portal.

For the receipt, storage, obtaining, dissemination or transmission by Users of content from the Portal or its courses.

For knowledge of any information that unauthorized third parties may possess or use regarding the characteristics and circumstances of Users' use of the courses, content and services of the Portal.

For failure by third parties to comply with their obligations or guarantees arising from or undertaken in relation to the services provided to Users through the Portal, as well as for any lack of quality, reliability, conformity with what was offered, legality, usefulness and availability of the services provided by third parties and made available to Users on the Portal.

The foregoing list is merely illustrative and is in no case exclusive or exhaustive in any of its points. In all cases, BISITE-USAL excludes any liability for damages of any kind arising directly or indirectly from them and from any other unspecified circumstances of a similar nature.

8.- Links.

The Portal may include within its content links to sites owned and/or managed by third parties for the purpose of facilitating access to information and services available through the Internet.

BISITE-USAL assumes no liability arising from the existence of links between the content of the Portal and content located outside it or from any other mention of content external to this site. Such links or mentions are for informational purposes only and under no circumstances imply support, approval, marketing or any relationship between BISITE-USAL and the persons or entities that author and/or manage such content or the owners of the sites where it is located, nor any guarantee by BISITE-USAL regarding the proper functioning of the linked sites or content.

In this regard, the User undertakes to exercise the utmost diligence and caution when accessing or using content or services from sites accessed through the aforementioned links.

9.- Intellectual and Industrial Property Rights.

The texts, designs, images, databases, logos, structure, trademarks and other elements of the Portal are protected by laws and international treaties on intellectual and industrial property. Any reproduction, transmission, adaptation, translation, modification, communication to the public, or any other exploitation of all or part of the content of this site, carried out in any form or by any means, electronic, mechanical or otherwise, is strictly prohibited unless previously authorized in writing by the corresponding owner or unless such content is subject to “creative commons” licenses, in which case the uses covered by such licenses shall be permitted in accordance with the applicable license type in each case. Any infringement of these rights may give rise to the corresponding extrajudicial or civil or criminal judicial proceedings.

BISITE-USAL does not grant any license or authorization of any kind for the use of its intellectual and industrial property rights, or any other property or right related to the Portal, its services or their content.

The legitimacy of the intellectual or industrial property rights relating to content provided by third parties is their sole responsibility.

For the purpose of preserving possible intellectual property rights, if any User or third party considers that their legitimate rights have been infringed by the inclusion of certain content on the Portal, they must notify BISITE-USAL of this circumstance in writing, indicating:

Personal identification details of the interested party who owns the rights allegedly infringed. If the claim is submitted by a third party other than the interested party, they must indicate the capacity in which they are acting.

Identification of the content protected by intellectual property rights and its location on the Portal.

Evidence of the existence, ownership and validity of the aforementioned intellectual property rights.

An express declaration in which the interested party accepts responsibility for the truthfulness of the data and information provided in the notification referred to in this section.

10.- Loss of User Status.

The registered User may unsubscribe from the Portal, thereby losing such status and the rights and data associated with their account, freely and at any time, with no requirement other than submitting a written request to campus@e4YOU.org indicating the email address used on the Portal, or indicating this email address together with their first name, last name and password.

Likewise, the User may withdraw at any time from the courses in which they have enrolled by clicking on the option provided for this purpose.

BISITE-USAL may also terminate the User's account, thereby ending the relationship established between them and causing the User to lose the rights deriving from such status and the data associated with their account on the Portal, in the following cases:

If the User breaches any of these Terms.

If provision of the Portal's services, or any of them, ceases to be commercially viable in the judgment of BISITE-USAL.

Loss of User status does not exclude application of these Terms, which shall continue to apply to any matters or claims that may arise between BISITE-USAL and the User after such status has been lost.

11.- Right of Withdrawal.

The refund or withdrawal policies for products and services offered on the Portal are set out, for each type of course and certificate, in clause 6 of these Terms.

12.- Applicable Law and Jurisdiction.

Access to, use and/or utilization of the services or content of this Portal, these Terms insofar as they regulate them, and all matters arising therefrom are subject to Spanish law. For any matters that may arise or actions that may be brought as a result of the management of the Portal by BISITE-USAL and its services and content, and regarding the interpretation, application, compliance or non-compliance with the provisions herein, the User may submit to the jurisdiction of the Courts and Tribunals of the city ofSalamanca (province ofSalamanca, Spain).
